Terms of Use and End User License Agreement

I. INTRODUCTION

This Agreement, comprising the Terms of Use and End User License Agreement, establishes a binding contract between you, a natural person ("you", "your", or "user"), and Ask AI Chatbot: Zenova AI ("we", "us", or "our"). It pertains to your access and utilization of the "Zenova AI" software application for mobile devices (referred to as the "App"). Note that the App's title may differ in countries outside the U.S. and is subject to change without specific notice.

All documents related to the App are explicitly integrated into this Agreement by reference.

Kindly review this Agreement thoroughly before downloading, installing, or using the App.

Your download, installation, or use of the App signifies that you have read, comprehended, agreed to, and accepted the terms of this Agreement, which becomes effective upon your download, installation, or commencement of App usage.

Should you decline this Agreement or disagree with any of its provisions, you are not authorized to access, download, install, or use the App. If you have already undertaken any of the aforementioned actions, you must promptly remove the App from any mobile device under your possession or control.

II. CHANGES TO THIS AGREEMENT

We retain the right, at our sole discretion, to amend or modify this Agreement at any time and for any reason. We will keep you informed of any changes by updating this Agreement. It is your responsibility to periodically review this Agreement to remain informed of updates. Your continued use of the App after the posting date of any revised Agreement indicates your acceptance of the modifications.

III. RESTRICTIONS ON APP USAGE

To download, install, access, or use the App, you must have reached the age of majority or legal age in your jurisdiction (typically eighteen years or older).

Minors (individuals under the age of eighteen) must obtain parental or guardian permission and supervision to use the App. Users aged thirteen to seventeen must ensure parental or guardian consent and have the legal capacity to enter into an agreement with us.

Minors under the age of thirteen are prohibited from accessing, downloading, installing, or using the App.

By agreeing to this Agreement, you affirm that you have reached the age of majority, possess legal parental or guardian consent, and are fully capable of adhering to the terms outlined herein.

IV. GENERAL TERMS

The App is designed for entertainment purposes and provides tools based on Artificial Intelligence models for interactive chatting and answering queries. Refer to the App's page on play.google.com for a comprehensive list of functionalities.

The App is intended for personal, non-commercial use only and must be utilized accordingly.

V. PRIVACY POLICY

Our Privacy Policy governs the processing, usage, and storage of information, including personal data. By accessing the App and using its services, you implicitly accept the terms of the Privacy Policy. We reserve the right to amend the Privacy Policy and advise discontinuation of App usage if you disagree with any part of the policy.

VI. END USER LICENSE AGREEMENT

By using the App, you agree to respect our Intellectual Property Rights and those of third parties. The License grants you limited, non-exclusive rights to access and use the App for personal, non-commercial purposes. Unauthorized use of copyrighted materials within the App is prohibited.

VII. THIRD-PARTY MATERIALS AND BEHAVIORAL GUIDELINES

The App incorporates OpenAI API for AI-generated content. Users must comply with OpenAI's Sharing & Publication Policy when sharing or publishing User Content.

Prohibited behavior includes unlawful, defamatory, obscene, offensive, or harmful actions. Users must refrain from generating inappropriate content, including hate speech, violence, self-harm, or illegal activities.

VIII. PROHIBITED ACTIONS AND USAGE TERMS

Users are prohibited from unauthorized distribution, modification, or reverse engineering of the App. Misuse of copyrighted materials within the App is strictly prohibited.

IX. AVAILABILITY, SECURITY, AND ACCURACY

Access to the App requires compatible mobile devices and internet access. We do not guarantee uninterrupted or error-free access to the App. We reserve the right to upgrade or modify the App without prior notice.

X. CHARGES AND SUBSCRIPTIONS

The App is available free of charge, providing users with access to its basic features upon download.

Certain services and additional features within the App, referred to as "Premium options," necessitate paid subscriptions.

During the signup process, users may have the opportunity to explore Premium options through a free trial period.

Upon expiration of the free trial, an auto-renewing subscription period will commence regularly. Users are advised that automatic charges will occur unless the subscription is canceled 24 hours before the free trial concludes. Cancelling the subscription still grants access to basic App functions, with Premium options available throughout the free trial.

Users can select from various subscription options, with prices listed in U.S. dollars and potential variations in other countries. Detailed information about subscription plans and free trial durations is provided on the signup screen before purchase.

Subscriptions with free trial periods automatically transition to paid subscriptions. Any unused portion of the free trial is forfeited upon purchasing a subscription. The provider retains the right to modify, terminate, or amend subscription plans.

Auto-renewing subscriptions bill users no earlier than 24 hours before each new billing period. Users can cancel subscriptions before the end of the relevant billing period, as outlined, with the cancellation applying to the subsequent period. No cancellation is allowed during an active subscription period, and users manage their subscriptions.

Removing the App from a device does not deactivate the subscription. Users may incur charges from their communications service provider for downloading or accessing the App, including potential data roaming fees outside their permanent residence state. All such charges are the user's responsibility, and non-payment assumes permission from the responsible party.

XI. THIRD-PARTY WEBSITES AND RESOURCES

The App may direct you to external sites on the Internet and engage contracted third parties to offer specific services. We lack control over and disclaim any responsibility for the content of any linked websites or mobile applications unless we are the provider of those linked platforms. Linked websites and mobile applications are provided "as is" solely for your convenience, with no warranty, express, or implied, for the information they contain.

You acknowledge your sole responsibility and assume all risks arising from your use of any third-party websites or resources.

Any queries, concerns, or complaints regarding such third-party websites or mobile applications (including, but not limited to, issues related to products, product orders, faulty products, and refunds) should be directed to the operator of the respective third-party website or mobile application.

XII. DISCLAIMER OF WARRANTIES

You acknowledge and agree that your utilization of the App and its services is entirely at your own risk. The services, along with all materials, information, software, and content integrated into the App, are provided on an "as is" and "as available" basis. We do not provide any warranties, either express or implied, concerning the merchantability, technical compatibility, or fitness for a specific purpose of any service, product, or material provided under this Agreement. We do not guarantee that the functions within the services will be available, uninterrupted, or error-free, that defects will be corrected, or that the services or the servers making the service available are free from viruses or other harmful components.

XIII. LIMITATION OF LIABILITY

We are not liable for any damages arising from App usage or third-party services accessed through the App. Users assume responsibility for their use of the App and agree to indemnify us against any claims arising from such usage.

XIV. LEGAL COMPLIANCE

Users must comply with U.S. laws and regulations and agree not to use the App from countries subject to U.S. Government restrictions.

XV. TERMINATION

We reserve the right to terminate this Agreement at our discretion, upon which users must cease App usage.
